GENERAL CONDITIONS
(pursuant to Chapter I, Title 3, Part 3, of the d.lgs 206/2005 and subsequent amendments and additions)

  1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, "General Conditions") govern the purchase of products and services, carried out remotely via the Internet, from the site www.neibacshop.com in compliance with the Italian legislation referred to in d.lgs 206/2005 and subsequent amendments and additions (hereinafter: “Consumer Code”).

The user of the site who intends to purchase (hereinafter the "Customer") is required, before confirming the order, to carefully read these General Conditions which have been published on the Site and which will be available to the Customer at any time, including through the link contained in the confirmation email of each order, to facilitate storage and reproduction.
If the user purchasing from the Site requests an invoice and/or is not a "consumer or user" as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the withdrawal provisions described in the relevant section will not apply, because, pursuant to the Consumer Code, they apply only to "consumers."

Agreements made with Neibac through the Site are governed by these General Conditions in compliance with Italian law. The reference language for concluding the contract is Italian for sales with deliveries to Italy, and English for all other delivery locations.

  1. Choosing and Purchasing Products

The characteristics and prices of the various products for sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each Product with a specific "Product Sheet." Each Product will include the net weight, region and country of origin, the name of the Manufacturer, and a technical sheet.

The Customer must add the Product(s) to the "Cart" and, after having read the General Conditions and the Privacy Policy and confirmed their acceptance by checking the appropriate box, must enter the shipping information, select the desired payment method and confirm the order. The invoice will be sent only upon request via email to neibacshop@gmail.com

By placing an order on the Site, which constitutes a contractual agreement, the Customer acknowledges and declares that he or she has read all the information provided during the purchase process, has read the technical data sheet, understands the characteristics of the Products, and fully accepts these General Conditions and those of the selected payment method.

The contract between "Neibac" and the Customer is deemed concluded upon acceptance of the order by "Neibac." This acceptance is communicated to the Customer via an order confirmation email to the address entered by the user during the order confirmation process. This email will contain a reference to these General Conditions, the order number, shipping information, the list of Products ordered, and the total price, including VAT, where applicable, and delivery charges.

  1. Product Information

The information and characteristics relating to the Products are available on the Site

Neibac guarantees that the delivered Products will be identical to those indicated and described on the Site, and ensures compliance with all product storage regulations until delivery to the location specified by the user when placing the order. The manufacturer is responsible for all products sold. For packaged products, the manufacturer is also responsible for the accuracy and completeness of the information provided on the packaging.

  1. Prices and shipping

Product prices include all taxes and duties. All prices are in Euros. Import duties may apply to the UK and Switzerland and are paid by the customer.

  1. Payment Methods

The Customer may pay the price of the Products and the related delivery costs by credit card, PayPal, Postepay and Satispay.

PayPal Once the order has been confirmed, the Customer will be redirected to the PayPal website where they can make the payment with their account or using a card, including a prepaid card, or in any case according to the methods accepted by PayPal and in compliance with the relevant conditions.

  1. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the specific "Shipping Data" field.

All purchases will be delivered by courier (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. "Neibac" is not responsible for unforeseeable delays or delays beyond its control.

In any case, except for reasons of force majeure or unforeseeable circumstances, the ordered Products will be delivered approximately within 15 working days from the day following the day on which “Neibac” confirmed the order to the Customer via a specific order confirmation email.

The service includes one delivery attempt to the address indicated at the time of ordering. If the delivery attempt is unsuccessful, the courier will leave a paper notification confirming the delivery, asking the customer to contact the nearest branch to arrange delivery or change the delivery address. The courier reserves the right to contact the customer by telephone in the event of a failed delivery, rather than leaving a written notification.

  1. Right of withdrawal

As required by the Consumer Code D.Lgs. 206/2005 and Legislative Decree 21/2014, customers who purchase from Neibac enjoy the right of withdrawal. The customer can request a refund or a free exchange within 14 days of receiving the goods, subject to the following conditions:

  • The Customer must communicate the intention to withdraw by writing to neibacshop@gmail.com or via WhatsApp at +39 320 419 2563.

  • Once the return is accepted, the customer will receive the return address via email or WhatsApp. From that moment, they have 14 days to ship the product.

  • Products must be returned intact, undamaged, and complete with all original packaging (cardboard, bubble wrap, and corner protectors where applicable).

  • The return shipment is at the Customer's expense and under his/her responsibility until it arrives at the Seller.

  • The Seller is not responsible for damage, theft or loss resulting from uninsured shipments.

Alternatively, the Customer has the option to request a free exchange of the purchased product. In this case, Neibac will organize and manage the collection and delivery of the new item free of charge.

The refund will be processed within 14 days of receiving the returned item and verifying its integrity, using the same payment method used for the original purchase. The original shipping costs or any insurance paid by the customer for the initial shipment will not be refunded.

The right of withdrawal lapses in the following cases:

  • Missing external packaging and/or original internal packaging;

  • Product damage;

  • Abnormal state of conservation;

  • Once the 14 day deadline has passed;

  • Absence of integral elements of the product.

In case of forfeiture of the right of withdrawal, the product will be returned to the Customer with shipping costs charged.

The following are excluded from the right of withdrawal:

  • Customized products (canvases with customer photos or non-standard sizes);

  • Framed products;

  • Products with hand retouching 
  • Products in "Outlet";

  • Products used or damaged by the Customer.

The Company will not consider refund requests from those who have not yet received their order. In this case, the Customer must wait for delivery and then follow the procedure indicated above.

  1. Warranty and defects of conformity for products

In case of lack of conformity of Products sold by Neibac the Customer must immediately contact Neibac by sending an email to neibacshop@gmail.comThe legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of Products. The Customer has the right, at his discretion and provided that the type of Product allows it, to have the Product's conformity restored, free of charge, through repair or replacement, or to an appropriate price reduction or to terminate the contract. The Customer will lose these rights if he does not report the lack of conformity to Neibac within 7 days of discovering the defect.

  1. Errors and limitations of liability

The Product information provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Neibac cannot be held responsible, except in cases of willful misconduct or gross negligence.

Except in the case of fraud or gross negligence, the Customer is excluded from any right to compensation for damages or the recognition of an indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the failure to accept or fulfill, even partially, an order.

  1. Complaints

Any complaints must be forwarded to Neibac by writing an email to the address neibacshop@gmail.com

Neibac undertakes to respond to all requests received within a maximum of 7 working days.

  1. Applicable law and competent court

The sales contract between the Customer and Neibac is deemed to have been concluded in Italy and is governed by Italian law. For disputes relating to the interpretation, execution, or termination of these General Conditions or individual purchase orders, if the Customer is a consumer pursuant to the Consumer Code, the court of the Customer's municipality of residence or domicile, if located in Italy, shall have exclusive jurisdiction. In all other cases, the Court of Verona shall have exclusive jurisdiction, excluding any other competent court.
